PSV Museum & Tours

1.           Applicability

1.1 These General Conditions PSV Museum / Stadium Tour (hereinafter "General Conditions") are used by PSV N.V., a limited liability company incorporated under the laws of the Netherlands, having its registered office in Eindhoven, the Netherlands, and located at (5616 NH) Frederiklaan 10A, Eindhoven, the Netherlands, registered with the Chamber of Commerce under registration number 17104199 (hereinafter referred to as "PSV"), and apply to each Visitor of and/or the right holder and/or holder of an Admission Ticket for (i) the PSV Museum, (ii) a PSV Stadium Tour, and/or (iii) Related Activities. Deviations from these terms and conditions apply only to the extent expressly agreed in writing with PSV.

2.           Definitions

Visitor: any person who, with or without a valid Admission Ticket, enters the PSV Museum and/or (as part of a PSV Stadium Tour or Related Activity) the Philips stadium. The Visitor to the Philips Stadium is further subject to the Internal Regulations Philips Stadium;

2.2 Reflection Period: the period within which the Visitor can exercise his/her Right of Withdrawal;

2.3 Day: calendar day;

Revocation: the possibility for Visitor to waive the Distance Agreement within the Reflection Period;

2.5 Philips Stadium Internal Regulations: the Internal Regulations of the Philips Stadium applicable to the Visitor of the Philips Stadium, which can be consulted via the following(link);

2.6 Agreement: the agreement to purchase an Admission Ticket to the PSV Museum, and/or the PSV Stadium Tour and/or Related Activity between PSV and the Visitor, including the Remote Agreement;

2.7 Distance Contract: a Contract whereby, in the context of a system organized by PSV for the distance sale of products, up to and including the conclusion of the Contract, exclusive use is made of one or more means of distance communication;

2.8 Entrance Ticket: an entrance ticket that provides access to the PSV Museum and/or the PSV Stadium Tour and/or a Related Activity.

3.           Access to PSV Museum

3.1 Access to the PSV Museum is only possible on presentation of a valid Entrance Ticket for the PSV Museum. An Entrance Ticket can be purchased online or at the ticket office of the PSV Museum / PSV Fanstore. An Entrance Ticket is only valid until 1 year after the day mentioned on the Entrance Ticket.

3.2 Entry to the PSV Museum may be denied without refund on the admission ticket if, in the opinion of PSV, it appears that:

a. Visitor is under the influence of alcohol or narcotics, or at least any other substance - including medications - that influence the Visitor's behavior in a manner unacceptable to PSV;

b. Visitor disturbs order or intends to disturb order;

c. The Access Ticket was not issued by PSV or a third party engaged by PSV.

3.3 PSV is entitled to carry out access control at the entrance or within the PSV Museum. The Visitor is obliged to cooperate with this access control. Access control may include the search of bags and luggage by or on behalf of PSV. If the Visitor withholds his/her cooperation with the access control, he/she may be denied access to the PSV Museum. In such a case, there will be no refund on the Entrance Ticket.

3.4. The Visitor is not permitted to bring into the PSV Museum any drink, drug, weapon, pointed or sharp object or any object likely to cause injury or damage to exhibits. If these objects are found during an entry control, they will be taken into custody. Objects that are prohibited by law will be handed over to the police. In the event the Visitor refuses to cooperate with the taking into custody or handing over, they may be denied access to the PSV Museum. In such a case, there will be no refund on the admission ticket.

3.5 PSV is entitled to limit the opening hours of and access to the PSV Museum to the extent it deems necessary in the context of other activities (including, but not limited to, PSV's home matches) or in the event of emergencies, such as a full or partial evacuation of the stadium.

4.           Staying at the PSV Museum

4.1 Visiting the PSV Museum is at the Visitor's own expense and risk. Children under the age of 14 must be accompanied by an adult at all times.

The Visitor shall at all times, during his/her visit to the PSV Museum, a Stadium Tour or an Associated Activity, comply with these General Terms and Conditions, as well as directions and instructions given by PSV personnel, the police, the Fire Brigade or the Public Health Service on site. If, in the opinion of PSV, the Visitor violates these General Terms and Conditions and/or the Internal Regulations and/or directions and instructions given on site, the Visitor may - without prior warning - be denied (further) access to the PSV Museum and/or further participation in a Stadium Tour or Related Activity, or be handed over to the police. Such action shall immediately and irrevocably result in the loss of validity of the Admission Ticket of the person concerned, without any obligation to refund PSV.

4.3 Camera surveillance is used in the PSV Museum for the security of the Visitor, staff and the collection. Camera images are processed in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC) and the Policy Rules on Camera Surveillance as published by the Personal Data Authority.

For security reasons, visitors must be identifiable at all times. It is not permitted - except for a governmentally prescribed face mask - to cover the face inside the PSV Museum and stadium.

4.5 PSV cannot guarantee that all parts of the Exhibition will be accessible, visible or open at all times. PSV is also not bound to provide a full or partial refund on the Entrance Ticket in such a case.

4.6 In the PSV Museum, as well as in the Philips Stadium, the Visitor shall refrain from:

a. Touching exhibits, except insofar as they are expressly intended to be interactive;

b. Obstructing other visitors or PSV Personnel in any way;

c. Consuming food or drink, as well as smoking tobacco (including electronic cigarettes). except in places where this is expressly permitted;

d. Making photo and/or video recordings for purposes other than strictly domestic purposes. Making photo and/or video recordings for commercial purposes is expressly prohibited

e. Any other commercial activity;

5.           Stadium Tour

5.1 In addition to a visit to the PSV Museum, a Stadium Tour can be booked. Booking a Stadium Tour is done online or at the ticket office in the FANstore. Participation in a Stadium Tour is only possible on presentation of an appropriate Admission Ticket and/or confirmation of booking.

5.2 A Stadium Tour can only be booked for a specific time slot. Modification or relocation of a booked Stadium Tour is not possible, except in those cases where PSV honors a modification or relocation in writing. Whether a change or relocation is possible depends, among other things, on the timeliness of a request to do so, as well as availability at the desired time slot.

5.3 Cancellation of a Stadium Tour is possible up to five working days prior to the date of the scheduled Stadium Tour, after which the full purchase price will be refunded. In case of cancellation within five working days prior to the scheduled Stadium Tour, 50% of the agreed price will be charged

5.4 In connection with activities (including but not limited to home matches), certain parts of the stadium may at any time not be accessible or only be accessible to a limited extent or the program for the Stadium Tour may be changed. Non- or limited access to parts of the Philips stadium will never lead to any obligation of PSV to provide a full or partial refund on the Stadium Tour.

5.5 PSV reserves the right to cancel Stadium Tours for reasons of its own (e.g. due to events and/or scheduled matches at Philips Stadium). In that case, the Visitor will be given the opportunity to reschedule the Tour or request a refund. Subject to the foregoing, cancellation of a Stadium Tour by the Visitor is not possible. PSV shall owe no (additional) compensation, except for the above refund as stipulated in this clause 5.5.

6.           Related Activity(s).

6.1 PSV may offer related activities, such as facilitating birthday parties for children, as well as organizing combination activities with other providers of activities inside and outside the Philips stadium ("Related Activity"). Booking a Related Activity is done online or at the ticket office in the FANstore. Participation in a Related Activity is only possible on presentation of a corresponding Admission Ticket and/or confirmation of booking.

6.2 Unless otherwise expressly agreed between the parties, a Related Activity can only be booked for a specific date and/or time slot. Modification or relocation of a booked Related Activity is not possible, except in those cases where PSV honors a modification or relocation in writing. Whether a change or relocation is possible depends, among other things, on the timeliness of a request to do so, as well as availability at the desired time slot.

In connection with activities (including but not limited to home matches of PSV or representative teams of the KNVB) the program for a Related Activity may be unilaterally changed by PSV. Such unilateral change never leads to any obligation of PSV to refund the Entrance Ticket for the Related Activity in full or in part or to compensation of (additional) damages.

6.4 PSV may set further conditions for Related Activities, such as, but not limited to a minimum number of participants.

6.5 PSV reserves the right to cancel Related Activities for reasons of its own. In this case, the Visitor will be given the opportunity to reschedule the Activity or request a refund. Subject to the foregoing, cancellation of a Related Activity by the Visitor is not possible.

6.6 PSV may depend on the availability and cooperation of third parties in the context of Related Activities. Parts of Related Activities of these third parties are subject to any terms and conditions of these third parties, which terms and conditions will be provided to Visitor at the conclusion of the Agreement.

7.           Online purchase of Admission ticket / Online booking

7.1 An Admission Ticket for the PSV Museum, as well as a booking for a Stadium Tour or Related Activity can be ordered online via <psv.nl/en/experience>. An agreement is established by offer and acceptance thereof. An offer is deemed to have been made by the Visitor after completing the form made available for this purpose, which is available via the website <psv.nl/en/experience>. PSV may accept the offer electronically. Upon acceptance by PSV, an Agreement is established between Visitor and PSV.

7.2 Payment of an Admission Ticket or booking for the PSV Museum, a Stadium Tour or Related Activity can be made by means of the payment modules (such as iDEAL) as offered within PSV's booking platform. The services of these payment modules are subject to the general terms and conditions of the relevant payment service provider.

7.3 A (digital) Admission Ticket and/or confirmation of booking for the PSV Museum, a Stadium Tour or Related Activity is only valid if it is printed in color or black and white on blank paper, A4 size or presented on any other medium (digital or otherwise), such as a cell phone or tablet.

7.4 Revocation of the Agreement is excluded pursuant to Article 6:230p sub e of the Civil Code (leisure services).

7.5 PSV shall never be obliged to refund an unused or lost Admission Ticket or booking.

8.           Liability

8.1.Except for intent or gross negligence on the part of PSV, PSV shall not be liable for any damage of any extent, direct or indirect, material or immaterial, resulting from a visit to the PSV Museum and/or the PSV Stadium Tour and/or any Related Activity and/or the Philips stadium, including but not limited to any injury, or damage, loss or theft of property.

8.2 Under no circumstances will PSV accept liability for damages for which the Visitor can claim compensation under an insurance policy, whether or not from a third party, such as liability insurance, health insurance and/or travel and accident insurance.

8.3 In any event, PSV's liability is limited to the amount equivalent to the cost of an Entrance Ticket or booking. Only to the extent that it would be established in court that the aforementioned amount is unreasonable, PSV's liability shall be limited to the amount actually paid out by PSV's insurer in the relevant case.

8.4 The Visitor is liable for all direct and indirect damage that he/she causes, whether or not as a result of not complying with these general terms and conditions and/or the Internal Regulations, and indemnifies PSV against claims from third parties in that regard. The original right holder (the person who proceeded to purchase) of the Admission Ticket is jointly responsible and jointly liable for damage caused by the holder of the Admission Ticket issued to a Visitor.

9.           Other

9.1 The applicability of these General Terms and Conditions does not affect the applicability of any other terms and conditions, including, where applicable, the Internal Regulations, the PSV Privacy Policy and other terms and conditions as published from time to time on www.psv.nl/en, which are declared applicable to the visit to the PSV Museum, the participation in a PSV Stadium Tour, the participation in a Related Activity and a visit to the Philips stadium.

9.2 For those cases not provided for in these general terms and conditions or not sufficiently provided for, the management of PSV shall decide.

9.3 Dutch law shall apply to these General Terms and Conditions and to the Agreement between PSV and the Visitor. Disputes shall be settled by the competent court of the District Court of Oost-Brabant.
